DJ Service Entertainment Agreement

This agreement is for DJ services of DJ NYX LLC (DJ NYX) for the engagement described below between the undersigned Purchaser of entertainment and DJ NYX LLC.

Entertainment services shall include KJ music, MC, wired microphones, and lighting.

Total performance fee agreed upon is (USD):

All payments should be payable to DJ NYX LLC via online-payment for deposit the day of on-line booking and via online payment or in-person at the even via cash or credit card payment for the reminder of performance fee. 

Overtime (if authorized), will be charged at the rate of .(USD/ per half hour):

DJ NYX shall attempt to play Purchaser's and Purchaser's guests' music requests, but shall not be held responsible if certain selections are unavailable.

This agreement of DJ NYX to perform shall be excused by detention of personnel by sickness, accidents, riots, strikes, epidemics, acts of God, Force Majure of any other legitimate conditions beyond DJ NYX's control.  If such circumstances arise, all reasonable efforts will be made by DJ NYX to find replacement entertainment at the agreed upon fees.  Should the event need to be rescheduled, DJ NYX will make all reasonable effort with the Purchaser to come to a mutually agreed upon date to perform.  Should DJ NYX be unable to procure a replacement, the Purchaser shall receive a full refund for the booked services.   Purchaser agrees that in all circumstances, DJ NYX liability shall be exclusively limited to an amount equal to the performance fee and that DJ NYX shall not be liable for indirect or consequential damages arising from any breach of contract.  This agreement guarantees that DJ NYX will be ready to perform at the start time of the engagement.  DJ NYX requires permission to access to the performance venue minimum 90 minutes before the engagement and up to 60 minutes after the engagement for setup and takedown.

Purchaser will take steps to protect DJ NYX's equipment, music, and personnel during the contracted period.  Any damages incurred due to a lack of reasonable protection on Purchaser's part will be payable by Purchaser to the extent of repair or replacement of damaged music and equipment.  In the event of circumstances deemed by DJ NYX to present a threat or implied threat of injury or harm to DJ NYX or DJ NYX's staff or equipment, DJ NYX reserves the right to cease performance at any time.  If the Purchaser is able to resolve the threatening situation in a reasonable amount of time (maximum 15 minutes), DJ NYX shall resume performance in accordance with the original terms of this agreement.  In order to prevent equipment damage or liability arising from accidental injury to any individual attending this performance, DJ NYX reserves the right to deny any guest access to the sound system, music recordings, or other equipment.  DJ NYX agrees to current liability insurance and a business license.

This agreement cannot be canceled or modified except by mutual written consent of both the Purchaser and DJ NYX.  If agreement cancellation is initiated by the Purchaser in writing and agreed to by DJ NYX, thirty days or more before engagement, Purchaser will be required to pay a $100 cancellation fee.  For cancellation less than thirty days of engagement, Purchaser shall be obligated to make full payment for the total fee agreed upon or sign a new agreement for a substitute engagement performed in the following six months, subject to DJ NYX availability.  Rescheduling for events cancelled due to inclement weather or a Pandemic shall be accommodated without penalty.

Purchaser shall provide DJ NYX with safe and appropriate working conditions.  This includes, but is not limited to, providing a 6 foot by 5 foot area for DJ NYX's main setup, space for setting up speaker stands, and a 120-Volt outlet (3-pronged with at least 15-amp availability) from a reliable power source within 20 feet of the performance area.  The Purchaser is responsible for providing crowd conrol if warranted, ensuring the venue meets all safety regulations and has appropriate music licenses and performance permits where applicable.  Purchaser accepts full responsibility and is liable for any damages, injuries, or delays that occur as a result of failure to comply with this provision.  Purchaser accepts full responsibility and is liable for any damages, injuries, or delays that occur as a result of failure to comply with any occupancy limits or fire code restrictions.  Smoke machines are not provided or allowed by DJ NYX.  The Purchaser will be liable for any damages or fees as a result of fire alarm consequences caused by smoke machines or overloading the electrical supply.

Electronic signature for these terms and conditions is required within 5 days of the booking.
